These Terms of Service are a practical draft for Sails. They should be reviewed by legal counsel before production use.
Agreement to these terms
These Terms govern your access to and use of Sails, including the website, workspaces, publishing features, connected tools, and related services.
By using Sails, you agree to these Terms. If you are using Sails on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
What Sails provides
Sails gives AI assistants a workspace where they can create files, organize projects, save progress, connect approved tools, run workflows, and publish finished work based on your instructions.
Sails does not replace your judgment. You are responsible for reviewing, approving, and managing what your AI assistant creates, changes, connects, or publishes through Sails.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate account information and keep it up to date.
You must notify us if you believe your account has been compromised or used without authorization.
Workspace content
You retain ownership of the content you upload, create, save, or publish through Sails, including files, notes, data, pages, reports, tools, and other project materials.
You grant Sails the permission needed to host, store, process, display, transmit, publish, and otherwise operate your content solely as necessary to provide the service, support the product, and comply with these Terms.
You are responsible for ensuring that you have the rights and permissions needed for any content you place in Sails or instruct an AI assistant to create, edit, or publish.
AI-generated output
Sails may be used with AI assistants that generate, edit, summarize, organize, or publish content. AI output can be incomplete, inaccurate, or unsuitable for your intended use.
You are responsible for reviewing AI-generated output before relying on it, sharing it, publishing it, or using it in business, legal, financial, medical, safety, or other important contexts.
Published work
Sails may allow you or your AI assistant to publish pages, reports, forms, tools, data views, sites, or other outputs. You are responsible for what you publish and for making sure it does not violate these Terms, applicable law, or the rights of others.
Do not publish private, confidential, unlawful, infringing, harmful, or sensitive information unless you have the right to do so and intend for it to be shared.
Connected tools
Sails may connect to external tools, services, data sources, APIs, or MCP servers that you authorize. You are responsible for approving connections, managing permissions, and complying with the terms of any third-party services you connect.
Sails is not responsible for third-party services, their availability, their security, or their handling of your data except as required by applicable law.
Acceptable use
You may not use Sails to:
- Break the law or violate the rights of others
- Upload, create, or publish content you do not have the right to use
- Send spam, phishing, malware, or deceptive content
- Attempt to gain unauthorized access to accounts, systems, data, or networks
- Interfere with, overload, disrupt, or abuse Sails or related infrastructure
- Bypass usage limits, security controls, or access restrictions
- Use Sails to create or distribute harmful, exploitative, or illegal material
- Misrepresent AI-generated content as human-created when disclosure is required by law or policy
We may suspend or terminate access if we believe your use of Sails violates these Terms, creates risk, or harms Sails, users, third parties, or the public.
Plans, billing, and payment
Paid plans are billed according to the pricing, subscription, or order terms presented when you purchase or renew. You authorize us or our payment processor to charge applicable fees and taxes.
Unless otherwise stated, fees are nonrefundable except where required by law. We may change pricing or plan features with notice where required.
Service changes
We may add, change, suspend, or discontinue features over time. We will try to avoid disrupting active customers, but we cannot guarantee that every feature will always remain available in the same form.
Privacy
Our Privacy Policy explains how we collect, use, and protect information. By using Sails, you also agree to our Privacy Policy.
Disclaimers
Sails is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not guarantee that AI-generated output will be accurate, complete, secure, lawful, or appropriate for your use case.
Limitation of liability
To the fullest extent permitted by law, Sails and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost business, or lost goodwill.
To the fullest extent permitted by law, our total liability for any claim related to Sails will not exceed the amount you paid to Sails for the service in the twelve months before the claim arose.
Indemnity
You agree to defend and indemnify Sails from claims, damages, liabilities, costs, and expenses arising from your use of the service, your workspace content, your published content, your connected tools, your violation of these Terms, or your violation of law or third-party rights.
Termination
You may stop using Sails at any time. We may suspend or terminate your access if you violate these Terms, create risk, fail to pay fees, or use the service in a way that could harm Sails, users, or third parties.
After termination, some information may remain in backups, logs, billing records, legal records, or published outputs unless deleted according to the available controls and applicable law.
Changes to these terms
We may update these Terms from time to time. If we make material changes, we will update the date above and may provide additional notice. Continued use of Sails after changes take effect means you accept the updated Terms.
